These Terms and Conditions govern the rules for using our website and the terms of purchasing NOCCA, a battery-powered electronic heat management system for shisha (hereinafter referred to as the “Product”). Please read these terms carefully before making a purchase or using our website.
1. GENERAL PROVISIONS
1.1 These Terms and Conditions regulate the relationship between the website operator (hereinafter referred to as the “Seller”) and the website user or buyer (hereinafter referred to as the “Buyer”).
1.2 By purchasing the Product, the Buyer agrees to these Terms and Conditions.
1.3 The Seller reserves the right to update these terms at any time. The current version is always available on the website.
2. PAYMENT TERMS
2.1 Payment Methods: The Buyer can pay for the Product via:
•Online payment gateway (credit/debit card)
•Bank transfer
•Cash on delivery (if available)
2.2 Prices: All prices are listed in euros (€) or US dollars (USD) and include applicable taxes and fees unless explicitly stated otherwise.
2.3 Invoices: The Buyer will receive an electronic invoice via email once the order is completed
2.4 Non-Payment: If payment is not received within 5 business days, the order will be automatically canceled.
3. ORDER FULFILLMENT AND CANCELLATION POLICY
3.1 Order Processing: Orders are processed within 1–3 business days after payment is received. The Buyer will be informed by email about the order status.
3.2 Shipping: Delivery time depends on the selected shipping method and destination. The Seller is not responsible for delays caused by the courier company.
3.3 Order Cancellation: The Buyer may cancel the order before it is shipped. If the order has already been shipped, the Buyer must accept the package and follow the Return policy.
3.4 Right of Withdrawal: The Buyer has the right to withdraw from the contract within 14 days of receiving the Product, provided it has not been used and is in its original packaging. Return shipping costs are borne by the Buyer.
4. INTELLECTUAL PROPERTY RIGHTS
4.1 All content published on the website, including but not limited to texts, images, graphics, logos, trademarks, trade names, software, and downloadable files, is the intellectual property of the Seller or its licensing partners and is protected under applicable international intellectual property laws.
4.2 Users may use the content for personal, non-commercial purposes only. Any other use, copying, distribution, modification, or commercial exploitation of the content is strictly prohibited without prior written consent from the Seller.
4.3 The technology of the battery-powered device, including its design, features, and functionality, is protected by relevant patents, trademarks, and other intellectual property rights.
4.4 Unauthorized use or infringement of the Seller's intellectual property may result in legal action and/or immediate suspension of access to the website or related services.
5. LIABILITY DISCLAIMERS
5.1 Product Usage: Users must follow all safety and usage instructions provided in the User Manual. The Seller is not responsible for damages resulting from improper handling, unauthorized modifications, or failure to comply with the guidelines stated in the manual.
5.2 Website Availability: While the Seller strives to maintain continuous website availability, temporary unavailability due to technical errors may occur. The Seller is not liable for such interruptions.
5.3 Data Loss: The Seller implements industry-standard security measures to protect user data. However, the Seller is not responsible for data loss resulting from unavoidable technical failures or unauthorized access by third parties beyond the Seller’s control.
5.4 External Links: The website may contain links to third-party sites for convenience or reference. The Seller does not endorse, control, or assume responsibility for the content, accuracy, or security of these external sites.
6. WARRANTY AND CLAIMS POLICY
6.1 Warranty Period: The Product is backed by a 24-month warranty, starting from the date of purchase. The included batteries are covered by a 12-month warranty from the date of purchase.
6.2 Claims: The Buyer must report claims without undue delay via the contact form or email provided by the Seller.
6.3 Claims Process: The Buyer must provide proof of the defect (e.g., photos, a detailed description of the defect, and proof of purchase). The Seller will evaluate and resolve the claim within 30 days of receiving all necessary documentation.
6.4 Exclusions: The warranty does not cover damages caused by improper use, unauthorized modifications, or failure to follow usage and maintenance instructions. The natural wear and tear of consumables such as batteries beyond the warranty period is excluded.
7. APPLICABLE LAW AND DISPUTE RESOLUTION
7.1 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Slovak Republic unless mandatory consumer protection laws in the Buyer’s country provide otherwise.
Any disputes arising out of or related to these Terms shall be resolved through negotiation in good faith, and if unresolved, shall be submitted to the exclusive jurisdiction of the courts of the Slovak Republic, unless otherwise required by applicable laws.
7.2 Out-of-Court Dispute Resolution: For buyers in the EU, disputes may be resolved via the Online Dispute Resolution (ODR) platform managed by the European Commission. For buyers outside the EU, alternative dispute resolution methods may be considered based on the Buyer’s location and applicable laws.
7.3 Legal Disputes: If a dispute cannot be resolved out of court, it will be submitted to the competent court in the Slovak Republic. For buyers in jurisdictions where local consumer laws apply, disputes may be resolved in accordance with those laws.
